Primary duty of care & shared responsibilities

HydPower Hydraulics

HydPower Hydraulics (“HydPower”) supplies goods strictly in accordance with the specifications requested by the purchaser and as detailed in the relevant Quote, Offer, Order Confirmation, Invoice or Scope of Supply.

1. Nature of Supply

Unless expressly agreed otherwise in writing, all goods supplied by HydPower are provided as individual hydraulic, electrical, mechanical, or control components, assemblies, hydraulic power units, or sub-systems intended for integration into a broader machine, plant, or operating system.

HydPower does not assume the role of machine designer, system integrator, or principal contractor unless expressly stated in a written agreement.

2. Electrical Compliance Responsibilities

Where required by legislation, supplied electrical items are registered and supplied with an applicable Certificate of Electrical Safety, confirming compliance of the individual component only at the point of supply.

The purchaser and/or owner is solely responsible for ensuring that:

  • Electrical supply capacity, switchboards, circuit protection, earthing, wiring, isolation, and plug-in points are suitable for the application
  • All installation, connection, commissioning, testing, and verification are carried out by a licensed and competent electrician
  • The completed installation complies with all applicable Electrical Safety Acts, regulations, network provider requirements, and AS/NZS standards

HydPower accepts no responsibility for electrical non-compliance arising from site conditions, third-party installation, or downstream system integration.

3. Hydraulic & Fluid Power Responsibilities

While HydPower supplies hydraulic components and systems designed to meet nominated performance parameters, the purchaser and/or owner is responsible for ensuring:

  • Correct system integration, pressure ratings, flow capacity, temperature limits, and duty cycles
  • Appropriate selection and compatibility of hydraulic fluids
  • Adequate filtration, cooling, hose routing, protection, and burst containment
  • Compliance with relevant AS/NZS, ISO, and industry hydraulic safety standards

Incorrect installation, contamination, misuse, over-pressurisation, or operation outside design limits may result in system failure, injury, or damage, for which HydPower bears no responsibility beyond the supplied goods.

4. Mechanical & System Integration Responsibilities

The safe operation of the completed machine or plant depends on correct:

  • Mechanical integration and structural support
  • Guarding, emergency stops, interlocks, and control logic
  • Maintenance access and isolation provisions

Responsibility for the final machine design, system architecture, safeguarding, and operational safety rests with the owner and/or purchaser, including where HydPower-supplied goods are retrofitted, modified, or integrated into existing equipment.

5. Work Health & Safety (WHS / OHS) Obligations

Under applicable Work Health and Safety Acts / Occupational Health and Safety Acts, the owner and/or purchaser is a Person Conducting a Business or Undertaking (PCBU) and holds the primary duty of care to ensure, so far as is reasonably practicable, that:

  • Workers, contractors, and other persons are not exposed to health or safety risks
  • Plant and machinery are safe to operate, properly maintained, and fit for purpose

6. Risk Assessment & Machinery Lifecycle

In accordance with legislative requirements and prevailing AS/NZS Standards, the owner and/or purchaser must:

  • Conduct a machine-specific, task-based risk assessment prior to commissioning
  • Identify hazards across the full lifecycle, including installation, operation, maintenance, fault-finding, modification, and decommissioning
  • Implement appropriate engineering, administrative, and training controls
  • Review and update risk assessments whenever machinery, systems, or operating conditions change

7. Operational, Financial & Legal Responsibility

The owner and/or purchaser assumes full responsibility for:

  • Operator training, supervision, and safe work procedures
  • Ongoing inspection, servicing, and compliance audits
  • Any losses, damages, downtime, penalties, claims, or liabilities arising from incorrect installation, integration, operation, modification, or regulatory non-compliance

To the extent permitted by law, HydPower excludes liability for indirect, consequential, or downstream losses beyond the scope of the supplied goods.
